Terms and Conditions

These Terms and Conditions (hereinafter, the "Terms and Conditions") describe the terms under which SLIK PRO ("SlikPro") offers you (hereinafter, "You" or the "User") its services through the site www.slikpro.com (hereinafter, the "Site"). By using or accessing the Site, or any application, product, software, or service provided through the Site (all of which, together with the Site, are referred to as the "Platform"), you agree to (1) these Terms and Conditions and (2) SlikPro's Privacy Policies. If you do not agree with them, you must not access the Site or use the Platform.

SlikPro reserves the right, in its sole discretion, to change, modify, add, or remove portions of these Terms and Conditions and/or its Privacy Policies at any time. Such changes will take effect immediately upon their posting on the Site or from the moment Slik notifies you of them. Although Slik intends to notify its users of changes to the Terms and Conditions and Privacy Policies, you should periodically review the Site to access the most recent version. If you continue to use the Platform after the changes are posted, such use implies your acceptance of the changes.

SlikPro allows you to measure the climate, culture, and all stages of the employee lifecycle in a company.

Through the platform, you can create all types of surveys related to workplace climate, pulse, personnel selection, induction, promotion, and employee exit, among others, using your own questions or those from the “Proven Survey Library”; analyze the results of the various surveys as they are completed; and select, create, and manage action plans.

If you are using the Services on behalf of a company or any other entity, you agree to these Terms on behalf of that entity, and you represent that you have the authority to do so. In such a case, "you" and "your" will refer to that entity. Furthermore, since the Services are available only to individuals who are at least 18 years of age, you represent and warrant that you are at least 18 years of age and assume full responsibility for the selection and use of the Services. These Terms are void where prohibited by law, and the right to access the Services is revoked in such jurisdictions.

Within THE PLATFORM, there are various functional tools (hereinafter “Functionalities”) created to manage different human resources processes. These Functionalities can be viewed within THE PLATFORM as distinct modules.

Company Module: A module designed to create, delete, manage, and update offices, departments, and users with different types of permissions. Surveys Module: A module designed to create surveys such as workplace climate, pulse, engagement, selection, induction, promotion, and employee exit, among others, either from scratch or from our library. Reports Module: A module designed to visualize statistics generated by the various responses obtained through the Surveys Module. Action Plans Module: A module designed to create different action plans based on the various responses obtained through the Surveys Module.

To use the Platform, you must register for a Services account. You warrant that any registration information (such as name, contact information, or other information) that you submit to SlikPro is accurate, complete, and not misleading, and you agree to keep such information updated. Failure to do so constitutes a breach of these Terms and may result in the immediate termination of your account. To the extent that you may select a "username," you may not (i) select or use a username that is the name of another person with the intent to impersonate that person; (ii) use a username that is a name subject to the rights of a person other than you without appropriate authorization; or (iii) use a username that is offensive, vulgar, obscene, or illegal. We reserve the right, in our sole discretion, to cancel or refuse the registration of any username that we deem to violate these Terms, our policies, or the law. You are responsible for maintaining the confidentiality of your password and other account information. Your username must be used by only one person; a single login shared by multiple people is not permitted. Slik is not responsible for any loss or damage resulting from failure to comply with this Section. We may use your registration information and any technical information about your use of the Services to tailor our presentations to you, facilitate your movement through the Services, communicate with you separately, or publish the fact that you are a user of our services.

These Privacy Policies (hereinafter, the “Privacy Policies”) govern the processing of information collected from Users on the Site: slikpro.com (hereinafter, the “Site”) and the mobile application “SLIK PRO” (hereinafter, the “Application”), collectively, the “Platform,” owned by SLIK PRO CORP (hereinafter, “SLIK” or the “Company”), and form part of the Site’s Terms and Conditions, to which the definitions contained therein apply. The purpose of these Privacy Policies is to describe the types of personal data and information of Users (hereinafter, “Personal Information”) that SLIK collects, the purposes for which it is used, the circumstances under which SLIK may disclose such Personal Information, and what rights Users have regarding its protection.

SlikPro offers "Business," "Pro," and "Enterprise" paid accounts. If you are a user who pays for the Services, you must pay the SlikPro Service fees in accordance with this Section 5 and our pricing policy ("Fees"). You will be billed for your first subscription period immediately after upgrading to a paid subscription. Subscriptions will automatically renew for a period equal to the previous subscription period. All fees will be billed in advance (monthly or annually, depending on the subscription you purchase), and the credit card you last used for a SlikPro transaction will be automatically charged at the start of each subscription period. All Fees are non-refundable; without limitation, we will not provide refunds or credits for partial months of Service, for upgrades or downgrades, or for unused months of an annual account. For any subscription upgrade, the credit card you last used for a SlikPro transaction will be automatically charged the new rate on your next billing cycle. We reserve the right to change the Fees and to institute new charges and Fees at the end of each subscription period. Unpaid fees are subject to a finance charge of 1.5% per month or the maximum permitted by law, whichever is lower, plus all collection costs. You will be responsible for all taxes associated with the Services, other than taxes based on SlikPro's net income.

In the event of switching from a "Business," "Pro," or "Enterprise" account to a lower-tier user account, the features previously available to the higher tier will be removed, and you will be limited to the basic features of the lower tier. Full access to survey data may not be available if you make use of an account prior to the features of the higher-tier account. To regain access, you may upgrade your account at any time.

The Services display content supplied by third parties that does not belong to SlikPro. Such content is the sole responsibility of the entity that makes it available. Consequently, you are responsible for your own Content and must ensure that you have all necessary rights and permissions to use it in connection with the Services. SlikPro will not be responsible for any actions you may take regarding your Content, including its public disclosure. Do not use content from the Services if you have not obtained prior authorization from its owner or if you are not authorized by law to do so.

Use of the Services does not grant you ownership of any intellectual property rights in the Services. You agree that all SlikPro content and materials delivered through the Services or made available by SlikPro (collectively, "Our Content") are protected by copyright, trademark, service mark, patent, trade secret, or other laws and proprietary rights. However, you may print or download a reasonable number of copies of Our Content for your own informational purposes, provided that you retain all copyright and other proprietary notices within the copies. Reproduction, copying, or distribution of any of our Content design elements for any other purpose is strictly prohibited without our prior written permission. Use of our content for any purpose not expressly permitted in these terms is prohibited. SlikPro reserves all rights not expressly granted in these Terms.

SlikPro will treat your Content with strict confidentiality and will only use and disclose it in accordance with these Terms of Use. Notwithstanding the foregoing, your Content will not be considered confidential information if: (a) it is or becomes public knowledge (other than through a breach of these Terms by SlikPro); (b) SlikPro had legal knowledge of the Content before receiving it from you; (c) SlikPro receives it from a third party without knowledge of a breach of any commitment to you; or (d) it was independently developed by SlikPro without reference to your Content.

You are responsible for all of your activities in connection with the Services and will defend, indemnify, and hold harmless SlikPro and each of its employees, contractors, directors, suppliers, and representatives from all liabilities, damages, losses, settlements, claims, actions, demands, costs, and expenses, including attorney's fees, arising out of or in connection with (i) your use or misuse of the Services, (ii) access to any part of SlikPro and the Services, (iii) Your content, or (iv) violation of these Terms.

You may cancel your account at any time by clicking the xxx link. The account screen provides a simple cancellation link. No other form of cancellation (such as by phone or email) will be valid. If you cancel the Services before your current subscription period ends, the cancellation will take effect immediately and your Content will be immediately deleted from the Services. You will not be charged for any subsequent subscription period. For clarity, amounts paid are non-refundable, and if your account is canceled in the middle of a subscription period, you will forfeit all amounts paid.

We may restrict, suspend, or terminate the Services we provide to you (i) if you fail to comply with these Terms or our policies (including, without limitation, failure to pay any fees due in connection with the Services), (ii) if you use the Services in a way that creates or may create liability for us, (iii) if you interfere with others' use of the Services, (iv) if requested by law enforcement, a court, or another government agency, or (v) if we need to investigate alleged misconduct on your part. Any restriction, suspension, or termination will be made by us at our sole discretion, and we will not be liable to you or any third party for any damages that may result from or arise out of such restriction, suspension, or termination of your account and/or access to the Services. In the event of an urgent matter, we reserve the right to take immediate action without prior notice. Additionally, unless you are a paid user, we reserve the right to terminate and delete your account if you have not accessed the Services for a period of 365 days or more.

Upon termination by you or SlikPro, (i) all of your content will be immediately deleted from the services, (ii) you will no longer be able to access (or attempt to access) the services, (iii) all fees owed to SlikPro will become immediately due and payable, and (iv) we will have no obligation to retain any of your content. You are solely responsible for exporting your content from the services prior to the termination of the services you receive. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.

By creating an account, you agree to receive electronic communications from us, including marketing emails, product updates, and other commercial messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Electronic communications may be in the form of emails sent by us to the email address associated with your account or communications posted by us on the SlikPro website.

If you have a problem or concern, we recommend that you first contact your account administrator or our live chat service to try to resolve any issues. However, in the case of formal proceedings, you and SlikPro agree that these Terms will be governed by and construed in accordance with the laws of the State of Delaware.
